When ES COMPANIES LLC dba ESHOMEIMPROVEMENT.COM (ES) supplies material and labor for the installation of windows, doors, siding and carpentry services for an owner-occupied, single-family residential home, ES warrants that its installation workmanship will be free from defects and will be accomplished according to manufacturers' installation instructions or accepted industry standards and practices. Who is covered: This warranty extends to the original homeowner that purchased the improvements from ES and to the first party that thereafter acquires, directly from such original homeowner, fee title to the home where such improvements were completed. This warranty is not transferable beyond the first party that acquires fee title to the home directly from the original homeowner. Warranty term: With respect to the original homeowner that purchased the improvements from ES, the warranty coverage is in effect for as long as such homeowner owns and occupies the home where the improvements were completed. With respect to the first party that acquires fee title to such home directly from the original homeowner, the warranty coverage is in effect for a period of 5 years from the completion of the work. See applicable exclusions below. What is covered: In the event of a valid warranty claim, ES will furnish labor to repair any defective installation workmanship. ES will also supply replacement materials when necessary to make such repairs. ES reserves the right to substitute materials that it believes are of equal value if materials identical to those originally installed are no longer readily available to ES when such repairs are performed. All replacement work and materials will be provided solely by ES or by parties designated by ES. The homeowner may not contract with another to provide such labor or materials unless otherwise directed in writing by ES. Repairs undertaken by the homeowner or third parties without the written approval of ES will void this warranty. What is not covered: This warranty does not cover damage related to acts of God, weather conditions, storm damage, fire, flood, earthquake, moisture, water, humidity retention or accumulation, mildew, mold, settlement or deterioration of the building structure, improper care, adverse effects of pollution, normal surface wear, accidental or intentional damage, manufacturing defects, failure of materials, or any cause beyond ES' control. In addition, this Warranty does not cover routine maintenance Page (e.g., caulking, cleaning). ES WILL NOT BE LIABLE IN ANY EVENT FOR CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING DAMAGE TO THE INTERIOR OR EXTERIOR OF ANY RESIDENCE WHETHER FOR BREACH OF THIS WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT, OR FOR ANY OTHER CAUSE. The total liability of ES for claims under this warranty shall be limited to, and in no event, shall exceed, in the aggregate, the total installed cost of the home improvement products originally installed by ES. Modification of warranty: This warranty may not be changed or modified except in writing, signed by an authorized officer of ES. Sole and Exclusive Warranty: THIS WARRANTY IS ES' SOLE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED. EXOVATIONS DISCLAIMS ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. This Warranty does not replace any warranties made by the manufacturer of the materials installed by ES, and any claims relating to defective materials should be made directly to the manufacturer of such materials as stated in its written warranty. WORKMANSHIP WARRANTY EXCLUSIONS PAINTING • Painting workmanship warranty limited to 5 years on fiber cement surfaces from the completion of the work • Painting workmanship warranty limited to 3 years on all other surfaces from the completion of the work MASONRY • ES offers a 5 year warranty on workmanship for all new brick, stone and flagstone installations that has a concrete base installed by us. • ES offers a 1 year warranty on workmanship for all concrete work and installations of brick, stone and flagstone over existing concrete bases. ES Masonry Warranty as described above is not transferable. For a period of twelve (12) months following date of masonry installation, as set herein, ES will make repair(s) for any defect that meets or exceeds the following construction standards: • Broken or cracked mortar joints in brick or stone on a concrete base installed by us. • Loose stone or bricks. • Cracks in concrete flat work greater than 3/16 inch in width or 1/8 inch in vertical displacement. Expansion joint cracks greater than 3/4 inch in width and 3/8 inch in vertical displacement. • Uneven concrete flat work that exceeds depressions of 1/4 inch in 36 inches. • Concrete flatwork that settles, heaves or separates more than 1 inch under normal conditions. The following items and conditions are specifically excluded from MASONRY work warranty coverage: SURFACE CRAZING: The surfaces of many concrete slabs will be seen to exhibit a very closely spaced pattern of shallow, hairline, "craze cracks". Craze cracking is a very superficial due to expansion and contraction. Fortunately, craze cracks are benign, and since there is no reliable method available for avoiding them, no warranty is either expressed or implied regarding their occurrence. COLOR CONSISTENCY: While every possible effort will be made to ensure the concrete's uniformity over the course of the installation, no warranty is either expressed or implied herein regarding color consistency between adjacent placements. DAMAGE CAUSED BY ABNORMAL LOADING: Any use or loading of the concrete inconsistent with normal operations will immediately void this warranty. The owner is specifically cautioned against subjecting the concrete to any extraordinary point loading, as such loads can easily be sufficient to initiate both mid-length and corner cracking of the slab panels. HOW TO FILE A WORKMANSHIP WARRANTY CLAIM: To file a Workmanship Warranty claim, you must send written notice of the claim, a copy of your original ES contract, and a picture of the alleged defect, within 30 days after your discovery of the alleged claim. This warranty is extended to the original homeowner by ES COMPANIES LLC, dba ESHOMEIMPROVEMENT.COM (ES), as identified in this warranty. Subject to the terms and conditions put forth in this warranty, ES makes the following warranties to the original homeowner regarding the insulted glass panels of the replacement windows and patio doors installed on the property identified in this warranty. If a panel of insulated glass manufactured by our supplier and installed in one of its replacement windows or patio doors should break for as long as you own & reside in your home, ES will furnish a replacement panel at no charge. This warranty is limited to the furnishing of replacement insulated glass panels and does not cover or include any labor costs. Glass panels with mini blinds between the glass will not be covered in the Lifetime Limited Glass Breakage Warranty. ES will not be responsible for any cost incurred in the removal or reinstallation of the insulated glass panels or windows. Additionally, this warranty does not cover damages resulting from fire, flood, earthquake, lightning, ice, windstorms, tornados, hail or other acts of God or acts of civil unrest such as war, riots, etc. This warranty is not applicable for products installed in non-owner multi-family occupied dwellings or used for commercial purposes such as schools, churches, government owned structures, office buildings, etc. The warranties put forth are the only expressed warranties extended by ES in connection with glass breakage. The remedies set forth in this warranty shall constitute the original homeowner’s exclusive remedies, and ES shall not be liable to the homeowner for incidental or consequential damages for the breach of any expressed or implied warranties in connection with the insulated glass panels or windows. This limited warranty may not be changed or modified by any representative of ES or the manufacturer or is distributors or dealers. This warranty is limited to the original homeowner and is not transferable. For warranty claims please contact: ES Companies LLC, 3000 Lawrence St., Denver, CO, 80205. The claim must include the homeowners name, address, date of installation, and a copy of this warranty. Additionally, the homeowner must provide Proof of Purchase for each window or patio door. In order to qualify for warranty coverage, the homeowner must do this within 30 days of the date the glass breakage is first discovered.
